By securing a booking or utilizing our Service, you consent to this Agreement. In case of refusal to adhere to the Terms, our Service remains inaccessible to you.
2. Service Overview
PublicAccessEmporium specializes in high-end yacht charter offerings, featuring an array of services such as:

- Evening sailings
- Business getaway packages
- Exclusive celebrations
- Extended voyage hires
Our offerings are contingent on current availability and climatic conditions. Services can be adjusted or terminated without prior notice.
3. Booking and Reservations
3.1 Booking Process
Charter reservations require that you:
- Have reached the milestone of 18 years of age
- Submit valid and comprehensive details
- Make an advance payment as delineated within your booking confirmation
- Comply with and accept these Terms & Conditions
3.2 Confirmation
Your booking achieves confirmed status upon our acknowledgment of payment and our subsequent written affirmation. We retain discretionary rights to decline service to any individual.
3.3 Availability
Charter availability is based on vessel accessibility and favorable meteorological conditions. We will attempt to accommodate your preferred scheduling, although no guarantee is furnished.
4. Payment Terms
4.1 Pricing
Quoted prices are presented in € and encompass any relevant taxes unless explicitly excluded. These prices are amenable to change without prior notification.
4.2 Payment Schedule
- Deposit: A 50% down payment of the overall charter expense is due at the time of reservation
- Remaining amount: Expected 48 hours in advance of charter commencement
- Supplementary charges (as applicable): Payable upon charter finalization
4.3 Payment Methods
Accepted payment options include credit cards, bank wire transfers, and verified cheques. Payments are processed through a secure and encrypted platform.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellations beyond 72 hours before departure time: Complete reimbursement notwithstanding processing costs
- Between 24 and 72 hours before departure: 50% refund granted
- Within 24 hours of departure time: No refund provision
5.2 Weather Cancellations
Should our captain deem weather conditions unsafe, we will propose to:
- Reschedule your charter to another suitable date devoid of any additional fees
- Process a full refund should rescheduling prove unviable
5.3 Mechanical Issues
Should there be technical difficulties with the designated vessel, we will endeavor to offer an adequate alternative. If such cannot be provided, a total refund will ensue.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are obligated to:
- Adhere to all directions from the crew
- Utilize safety gear as and when mandated
- Declare health conditions potentially impacting safety
- Stay within permitted areas aboard the craft
6.2 Prohibited Items
Onboard prohibitions include:
- Glassware
- Contraband substances
- Arms or harmful weapons
- Excess amounts of any substance beyond moderate personal use
- Animals (save for previously authorized exceptions)
6.3 Conduct
We expect passengers to behave respectfully. Charter termination without refund may occur if passenger behavior endangers safety or detracts from others' experiences.
7. Liability and Insurance
7.1 Our Liability
Liability on our part remains restricted to the charter fee you have settled. We hold no responsibility for:
- Injuries due to passenger negligence
- Loss or damage of personal belongings
- Non-direct, incidental, or punitive repercussions
- Delays attributed to weather or factors beyond our reasonable control
7.2 Insurance Coverage
Our operations and vessels are secured by comprehensive marine insurance. Passengers must see to their own travel and personal indemnity plans.
7.3 Assumption of Risk
Engaging in our services signifies your admission to the intrinsic risks involved in marine activities. Responsibility for your safety lies with you.
8. Modifications and Itinerary Changes
Alterations to itineraries, travel paths, or timetables may occur due to meteorological conditions, safety protocols, or other critical necessities. We will strive to offer equitable alternatives as circumstances allow.
9. Force Majeure
No accountability for postponements, terminations, or service alterations stemming from unforeseeable control-exempt situations, inclusive of but not confined to:
- Extreme weather scenarios
- Catastrophic events
- Legislative mandates
- Port shutdowns
- Mechanical failures
10. Privacy and Data Protection
We manage your personal data in conjunction with our Privacy Policy. Service usage equates to your consent to our data collection and application per the policy description.
11. Intellectual Property
Our website's content, including texts, visuals, symbols, and imagery, are subject to copyright and trademark protection. Unauthorized content reproduction or derivative work creation requires our written consent.
12. Governing Law
This Agreement is subject to enforcement and interpretation according to the laws of Germany. All disputes fall under the exclusive jurisdiction of the courts in Hamburg, Germany.
13. Changes to Terms
